These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) or (“community”) and PhoenixAC, “we”, “us”, or “our”), concerning your access to and use of the http://phoenix-ac.com website as well as any other media form, application, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”). By purchasing our products, accessing our services and/or visiting the “site”, you agree to the Terms of Service. We reserve the right to update these terms at any given time.
Usage
Permission is granted to temporarily download one copy of the materials on Phoenix Anti-Cheat’s website and service for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
1. Modify any provided materials or create copies of any file, resource or similar provided.
2. Use the materials for any commercial purpose or for any public display.
3. Attempt to reverse engineer any software contained in our service.
4. Remove any copyright or other proprietary notations from the materials.
5. Transferring or sharing the materials to another person or "mirror" the materials on any other server or FiveM community. This includes restricted modules.
6. Use our product to create a similar service, that of which includes a "web panel/user dashboard" of similar style.
By purchasing PhoenixAC, you agree to the following terms:
Licence transfer includes a fee of $25.00 as administration costs.
Excessive changes to ones server circumstances which results in multiple security trips (example: licence being revoked constantly) may result in cooldowns or potential fees at Staff discretion.
You are only licensed to one server by default. Contact us if you wish to extend this. Attempting to extend this without contacting Staff will result in a revoked license.
By purchasing PhoenixAC, you understand that any bans issued by our IEC module are permanent and may not be lifted under any circumstances. This is due to security reasons - we will not unban any user regardless of their position.
It is not acceptable for license owners or their staff to send banned players to PhoenixAC requesting to be unbanned or information regarding their ban. Customers or registered developers are to contact PhoenixAC on the player's behalf, regardless of whether the ban occurred on the Customer's server or not.
Harassment, bullying or inappropriate behaviour towards PhoenixAC staff, support members, or other PhoenixAC customers will not be tolerated. Users partaking in this behaviour may be removed from our Discord server and be reduced to email support. Extreme cases may be grounds for license termination without compensation at discretion of PhoenixAC management.
PhoenixAC does not offer refunds. All purchases related to PhoenixAC are final and non-negotiable. By agreeing to these Terms of Service, you acknowledge that you are forfeiting your right of withdrawal as a resident of the European Union. Phoenix PhoenixAC uses the sale platform Sellix and PayPal to collect information regarding delivery, your set-up & ongoing usage of our services and this information is provided to PayPal & the payment provider in the event of a fraudulent chargeback.
We reserve the right to charge a $25.00USD admin fee for Customers that ignore provided warnings & information and:
Repeatedly attempt to install the anticheat on more than 1 server and cause subsequent excessive license revokes that follow.
Additional servers must have an additional license purchased in order to run Phoenix Anti-Cheat. Servers not included in this are overflow servers which are exact copies of the original server or test servers. Additional communities and/or additional game modes require an additional license.
If you gift your license to another person, you are relinquishing all rights as an owner and transferring all rights and responsibilities to them. You acknowledge that not claiming the license yourself means that you are no longer a customer of Phoenix and are not entitled to the license or access to our service. We will review cases where it is alleged the license was stolen on a case-by-case basis.
Bans issued for automatic executor detection (i.e. Eulen) are permanent, and will not be lifted from our bans system under any circumstances. PhoenixAC holds the right to decline pardons for executor bans for protection and security of these detections and modules. This includes testing bans.
Customers or affiliated Registered Staff Members or Developers are not permitted to commit or aid a player in committing ban evasion from the PhoenixAC global ban list. If a license owner suspects a ban of being false, they need to contact support. Committing or aiding in ban evasion (procuring or advising the procurement of alt accounts, etc) is strictly prohibited.
Customers must ensure that all false global bans are reported to PhoenixAC support within 48 hours of their creation and removal from the server's own ban list. A clear warning is presented when global ban types are removed from the customer's server bans. If global bans are not brought to the attention of PhoenixAC support, PhoenixAC may revoke access to the product until the issue is resolved. Ongoing failure to report false bans will result in permanent administrative action.
By accepting these Terms of Service, the Customer agrees to comply with the Terms of Service of all relevant platforms associated with PhoenixAC, including but not limited to Discord and FiveM. The PhoenixAC license is tied to the Customer's Discord account, and should the Customer lose access to their Discord account due to violations of its Terms of Service, PhoenixAC is not liable for loss of license or any associated services. In such an event, the PhoenixAC license may be suspended or revoked without refund, and PhoenixAC will not be responsible for any consequences that arise from a violation of another platform's Terms of Service. It is the Customer's responsibility to ensure that conduct on all platforms complies with their respective terms to prevent any impact on their PhoenixAC license.
This will let Phoenix Anti-Cheat to terminate upon violations of any of these restrictions. Upon termination, your viewing right will also be terminated and you should destroy any downloaded materials in your possession whether it is printed or electronic format. License termination will not include refund.
PhoenixAC does not permit the reselling or leasing of it's licenses by unpermitted parties. Licenses resold or leased without permission can be terminated at any time, with no compensation to the Customer.
Phoenix Anti-Cheat reserves the right to limit or remove access to the service at any time for violations of the above terms. This may include termination of an individual from the service, limit access to the service, or discontinue use and accessibility permanently to the service. We reserve the right to not allow access to "verified only" modules of PhoenixAC at our discretion without providing reasoning. Verified modules are not guaranteed at purchase.

Phoenix AC reserves the right to revoke a license & not issue a refund when;
The party and/or customer involved has ‘leaked’, distributed or attempted to crack Phoenix AC files.
The party and/or customer involved is found to be causing Denial of Service towards Phoenix AC and its Customers.
The party and/or customer involved is found to be a cheat developer.
The party and/or customer involved is found to have license shared after warning.
The party and/or customer involved is found to be operating maliciously against Phoenix AC.
The party and/or customer involved is found to be attacking another FiveM server and/or community protected by Phoenix AC.
The party and/or customer involved is found to be selling unbans or pardons from the PhoenixAC Global Ban list or PhoenixAC server ban lists.
The party and/or customer involved is found to be developing a product similar to our own.
The party and/or customer is found to have un-permitted usage of the license on additional servers owned or developed by the Customer.
The party and/or customer involved is found to be doxing, harassing, or exploiting information found via any PAC related service, including but not limited to: logs, game screenshots etc.
The party and/or customer is involved in reselling PhoenixAC licenses without formal consent.
Disclaimer
All the materials on Phoenix Anti-Cheat’s website and service are provided “as is”. Phoenix Anti-Cheat makes no warranties, may it be expressed or implied, therefore negates all other warranties. Furthermore, Phoenix Anti-Cheat does not make any representations concerning the accuracy or reliability of the use of the materials on its website and service or otherwise relating to such materials or any sites linked to this website. Staff reserve the right to cancel the service and not issue a refund.
The lifetime of the product is not the lifetime of any person/service involved with PhoenixAC. Features within PhoenixAC are not guaranteed for the duration of any license. Additional modules (such as IEC) are not guaranteed and are an additional feature for certain (verified) customers at staff discretion. PhoenixAC reserves the right to revoke access to these features at any time without a refund.
The installation included within the "Diamond" plan is a one-time installation conducted by a member of the PhoenixAC staff team with the "Installation Specialist" accreditation. The Customer has 30 days to organize this one-time installation before this feature of the Diamond plan is voided. Edits and fixes can be made to this installation by the Installation Specialist for a 24hr period after the install at the Customer's request. Ongoing maintenance of this installation is not included. PhoenixAC is not liable for a customer losing their installation due to mishandling of the product, i.e license revoke.
Installations conducted as an external installation service, including the installation services "Full Setup & Installation", "Initial Setup + Configuration", "Initial Setup - Configuration ONLY", and "Installation Repair", are under a 24 hour warranty period from completion of the installation. This warranty period is voided if the customer makes changes to the configuration and/or installation within the 24 hours. All payments made are final and are non-refundable. Ongoing maintenance of this installation is not included. PhoenixAC is not liable for a customer losing their installation due to mishandling of the product, i.e license revoke. Evidence is collected by the Installation Specialist proving that the service has been carried out in accordance with our policies, and this evidence is provided to the customer at the end of the installation service. This evidence will be provided to PayPal in the event of a chargeback.

Limitations
Phoenix Anti-Cheat or its suppliers will not be held accountable for any damages that will arise with the use or inability to use the materials on Phoenix Anti-Cheat’s website or service, even if Phoenix Anti-Cheat or an authorized representative of this website and service has been notified, orally or written, of the possibility of such damage. Some jurisdiction does not allow limitations on implied warranties or limitations of liability for incidental damages, these limitations may not apply to you.
PhoenixAC is not liable to ensure compatibility with all server host providers. If a server hosting service is not compatible with PhoenixAC, it is the responsibility of the Customer to remedy the issue with the provider or seek an alternative service. Refunds will not be provided in the event of an incompatibility with the Customer's hosting service.

This data is essential to the service operation of Phoenix AC and is a necessity. By purchasing Phoenix Anti Cheat, you agree that this information will be kept on Phoenix Anti Cheats core servers. Initial Setup & Configuration
The following terms apply to Customers of Phoenix Anti-Cheat requesting an "initial setup" or "custom config", "the service".
We reserve the right to deny or withhold the aforementioned services from any user as we see appropriate.
A 2 day and nil server change limited warranty is included in the service, which involves one of our Staff making documented edits in accordance with our provided documentation.
There is no warranty provided on the service if the time since the service was carried out exceeds 2 days or a modification to the server is made which our Staff may deem (at their discretion) related to the issue in which a warranty claim was made as a result.
We reserve the right to deny or withhold the aforementioned services from any user as we see appropriate.

Dependency on Citizen FX Platform
PhoenixAC is a software product designed to run on the Citizen FX platform known as "FiveM." The functionality and operability of PhoenixAC is inherently dependent on the continued compatibility with the FiveM platform.
Terms of Service
PhoenixAC does not guarantee, and is under no obligation to ensure, the continuity or performance of the FiveM platform, nor the continued compatibility of PhoenixAC with FiveM. If for any reason FiveM hinders, changes or discontinues services which affect the operation of PhoenixAC, PhoenixAC is not responsible nor liable for such hindrances or discontinuations.
Customers acknowledge and agree that they use PhoenixAC with the understanding of its dependence on the FiveM platform. In the event of any modification, suspension, discontinuance, or incompatibility of FiveM that affects PhoenixAC's performance or operability, PhoenixAC is not obligated to provide refunds or compensations of any kind to the customers.
The purchase and use of PhoenixAC is done at the customer's own risk. By purchasing PhoenixAC, the customer acknowledges and agrees that they have understood the inherent risks and dependencies associated with the use of PhoenixAC.
